Agreement

By accessing monarch-dayz.com or related Monarch group websites (the "Site"), you agree to these Terms and conditions ("Terms"). If you do not agree, do not use the Site. Commissioned work, retainers, and services tied to a specific brand may also be governed by a separate proposal, statement of work, or terms for that brand. If there is a conflict, the signed or written project terms prevail for that project.

Who we are

Using the Site

You may use the Site for lawful purposes only. You must not:

Attempt unauthorised access to any part of the Site, admin areas, or related systems
Introduce malware, scrape or harvest data at scale without permission, or overload our infrastructure
Misrepresent your identity or affiliation when contacting us or applying for work
Use content from the Site in a way that infringes our rights or another party's rights
Use the Site in any way that harms Monarch, our clients, our communities, or other users

We may suspend or block access if we reasonably believe these Terms have been breached or to protect the Site and our users.

Information on the Site

Content on the Site is provided for general information about Monarch services. We aim to keep it accurate but do not warrant that every description, availability note, or timeline on the Site is complete or current. Service scope, capacity, and pricing are confirmed in writing when you commission work.

Enquiries, tickets, and commissioning

Submitting a contact form or opening a ticket does not create a binding contract. A project begins when both sides agree scope, deliverables, timeline, and payment in writing (email confirmation or formal proposal). Availability of specific scripts, weapons, or assets may vary; we confirm what is possible at scoping.

Retainer hours are allocated per sprint as described on our Work with us page. Unused hours in a sprint do not roll over unless we agree otherwise in writing.

Payments and chargebacks

Payment terms are set in your proposal or invoice. Work starts or continues according to those terms. Chargebacks are not permitted for work delivered in line with the agreed scope. If you believe there is a problem with a delivery, contact us promptly so we can investigate and resolve it.

Intellectual property

Our content

The Site, its design, text, graphics, logos, and underlying code are owned by Monarch or our licensors and are protected by intellectual property laws. You may not copy, modify, or distribute them without our prior written permission except as allowed by law.

Client work

Ownership and licence for commissioned deliverables are set out in your project terms. Unless stated otherwise, Monarch may retain the right to use general know how, tools that are not unique to your project, and portfolio style excerpts where no confidential client information is revealed.

Game and platform rules

DayZ modding, server operation, and distribution may be subject to Bohemia Interactive, Steam Workshop, and other third party terms. You are responsible for compliance on your server and community.

Careers applications

Information you submit when applying for a role is handled under our Privacy policy. Providing false or misleading information may result in rejection or withdrawal of an offer.

Other sites and services

The Site may link to Operation Monarch, Monarch Modding, partner sites, social platforms, and other third parties. We do not control those services and are not responsible for their content, terms, or availability.

Disclaimer

The Site and any information on it are provided "as is" and "as available" to the fullest extent permitted by law. We do not guarantee uninterrupted operation or operation without errors. We disclaim implied warranties of merchantability, fitness for a particular purpose, and any implied duty not to infringe intellectual property where the law allows.

Limitation of liability

To the fullest extent permitted by law, Monarch and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from use of the Site or reliance on its content.

Our total liability arising from the Site or these Terms (other than liability that cannot be limited by law) will not exceed the greater of one hundred United States dollars (USD $100) or the amount you paid to Monarch for the specific service giving rise to the claim in the twelve months before the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

Indemnity

You agree to indemnify and hold Monarch harmless from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Site, your breach of these Terms, or your violation of another party's rights, except where caused by our intentional misconduct or negligence.

Governing law

These Terms are governed by the laws of the State of New Hampshire, United States, without regard to conflict of law rules. Courts in New Hampshire will have exclusive jurisdiction over disputes relating to the Site and these Terms, unless applicable law requires otherwise.

Changes

We may update these Terms from time to time. The last updated date appears at the top of this page. Your continued use of the Site after changes constitutes acceptance of the revised Terms to the extent permitted by law.
